Notice regarding the responsible party

The responsible party for data processing on this website is:

KINKY BERLIN e.V.
Torstrasse 22
10119 Berlin
Germany

Phone: +49-(0)30-97004734
Email: welcome@kinky-berlin.info

Represented by: Holger Quandt, Matthias Fuchs, Oliver Eiermann, Theresa Ziege

The responsible party is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data (e.g., names, email addresses, or similar).

2. Hosting

We host the content of our website with the following provider:

All-Inkl

The provider is ALL-INKL.COM – Neue Medien Münnich, Inh. René Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany (hereinafter referred to as All-Inkl). For details, please refer to All-Inkl's privacy policy: https://all-inkl.com/datenschutzinformationen/.

The use of All-Inkl is based on Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. If consent has been obtained, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

Data Processing Agreement

We have concluded a Data Processing Agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. Server Log Files

When you access our website, the hosting provider automatically collects and stores information in so-called server log files, which your browser automatically transmits. These are:

This data is not merged with other data sources. The legal basis is Art. 6(1)(f) GDPR. We have a legitimate interest in the technically error-free presentation and security of our website. The server log files are stored only for as long as necessary for these purposes and are then deleted.

4. General Information

Protecting your personal data is very important to us. We process your personal data exclusively on the basis of the statutory provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). In this Privacy Policy, we inform you about the type, scope, and purpose of the collection and use of your data.

5. Cookies

As a rule, our website does not use cookies. One exception applies when you open the form for submitting events: in this case, we set a technically necessary session cookie. It serves solely to protect the form against misuse (CSRF protection), does not contain any personal data, and is deleted at the latest when you close your browser.

The legal basis for this technically necessary cookie is § 25(2) no. 2 TDDDG; consent is not required for this. We do not set any analytics or marketing cookies (see the "Matomo" section).

6. Matomo (Web Analysis Without Cookies)

This website uses the open-source software Matomo to analyze user behavior. The data collected is stored exclusively on our own server and is not passed on to third parties.

We have configured Matomo so that web analysis is performed without setting analysis cookies. Your IP address is shortened (anonymized) before storage, so that it is not possible to draw conclusions about your person.

The legal basis for processing is Art. 6(1)(f) GDPR (legitimate interest). Our legitimate interest lies in analyzing user behavior to optimize our website offering. Since the tracking is carried out without analysis cookies and completely anonymized, consent under the GDPR is not required.

The following data is collected:

Do Not Track: We respect the "Do Not Track" setting of your browser. If you have activated this setting in your browser, your visit will not be recorded by Matomo.

7. Maps (CARTO)

We integrate an interactive map on our website. The map material (the map tiles) is provided by the CARTO service (operated by CARTO, based in the USA). The underlying map data originates from the OpenStreetMap project (© OpenStreetMap contributors).

For data protection reasons, the map is not loaded initially. Instead, you will see a button. Only when you click it is a connection established to CARTO's servers and the map loaded. In doing so, your IP address is transmitted to CARTO. Since CARTO's servers are located in the USA, your data is transferred to the USA.

The legal basis for this data processing is your consent pursuant to Art. 6(1)(a) GDPR, which you grant by clicking the button. The transfer to the USA is carried out on the basis of this consent pursuant to Art. 49(1)(a) GDPR. Without your consent, no data is transmitted to CARTO. Consent is voluntary and can be revoked at any time with effect for the future.

For more information, please refer to CARTO's privacy policy: https://carto.com/privacy. For information on the map data, please see the OpenStreetMap Foundation: https://wiki.osmfoundation.org/wiki/Privacy_Policy.

8. Contact by Email

If you contact us by email (e.g., for general inquiries or to submit events), the personal data you provide (in particular your email address and name) will be stored by us.

The processing of this data is carried out to handle your request and is based on Art. 6(1)(b) GDPR (performance of a contract or pre-contractual measures) and Art. 6(1)(f) GDPR (legitimate interest in responding to your inquiry).

Deletion: Your emails and the personal data contained therein will be deleted as soon as they are no longer required for processing your request and no statutory retention obligations prevent deletion.

When submitting event requests for our calendar, we store your email address in case your event is published, so that we can contact you. The email address will be stored together with the event until its expiration and will then be deleted.

9. Your Rights

As a data subject, you have the following rights:

To exercise your rights, please contact us using the contact details provided above.

10. Changes to This Privacy Policy

We reserve the right to amend this Privacy Policy as necessary to comply with current legal requirements or to implement changes to our services. The current version published on this website applies.
